In Prince George, British Columbia your creditors have the right to apply for a wage garnishment if you fail to pay your debts. However, in order to do so, they must first obtain an order form from the court. It is ultimately up to the court to decide how much will be garnished from your wages, or if they will be garnished at all.
It is not wise to try to convince your creditors to drop the garnishment, as they are likely doing it because you have a history of not paying your debts. If your creditors believed you would eventually pay, they would not be going through the trouble of a wage garnishment.
Some suggested ways to stop a wage garnishment include repaying the debt (which may be impossible), filing a consumer proposal, or at worst, filing for personal bankruptcy.
If your creditors are threatening you with wage garnishment, or if you believe they soon will be, please contact us immediately. Our licensed bankruptcy trustees can assist you in determining your best course of action, and will do their best to help you get your finances back on track.
